This Acceptable Use Policy ("AUP") governs use of the Opsvara platform and all related services, APIs, mobile applications, and websites operated by Solvara Labs LLC ("Solvara Labs," "we," "us," or "our") (collectively, the "Service"). This AUP is incorporated by reference into the Opsvara Terms of Service. Capitalized terms used but not defined herein have the meanings given in the Terms of Service.

By accessing or using the Service, you ("Customer," "you," or "your") — and all Authorized Users acting under your account — agree to comply with this AUP. Violations of this AUP may result in suspension or termination of your account, as described in Section 7 below.

1. Permitted Use

The Service is provided solely for lawful field service business operations. Permitted uses include:

Scheduling, dispatching, and managing field service jobs (e.g., lawn care, aquatic weed treatment, pool maintenance, painting, pest control, and similar industries).

Managing field worker accounts, routes, and job assignments.

Storing and processing client, site, and job records necessary for your business operations.

Generating invoices, estimates, and reports related to your field service business.

Using the Ask Opsvara AI Agent to obtain operational assistance, routing recommendations, and business insights.

Accessing the Service via our mobile applications for field-based data entry, photo documentation, and job completion.

Integrating the Service with authorized third-party tools via documented APIs and connectors.

2. Prohibited Conduct — General

You shall not use the Service to:

2.1 Illegal Activities

Violate any applicable federal, state, local, or international law or regulation, including but not limited to laws governing data privacy, environmental compliance, pesticide application, employment, and workplace safety.

Engage in any activity that constitutes fraud, misrepresentation, or deceptive trade practices.

Facilitate or promote illegal discrimination based on race, sex, religion, national origin, disability, sexual orientation, age, or any other protected characteristic.

Violate any export control or sanctions laws administered by the U.S. Department of Commerce, Treasury, or State.

2.2 Unauthorized Access and Security Violations

Attempt to gain unauthorized access to the Service, other accounts, computer systems, or networks connected to the Service through hacking, password mining, or any other means.

Probe, scan, or test the vulnerability of any system or network associated with the Service without Solvara Labs' prior written authorization.

Use automated tools, bots, scrapers, or scripts to access, index, or extract data from the Service in a manner that places an unreasonable burden on our infrastructure.

Introduce or transmit any malware, viruses, Trojan horses, worms, ransomware, spyware, adware, or other malicious or harmful code.

Attempt to interfere with, disrupt, or disable the Service or servers or networks connected to the Service.

Circumvent, disable, or otherwise interfere with security-related features of the Service, including features that prevent or restrict use or copying of any content.

2.3 Data Misuse

Use the Service to collect, store, or process personal information beyond what is necessary for your legitimate field service operations.

Upload, transmit, or store any data that you do not have the right to collect, use, or share, including data obtained without proper consent.

Use Customer Data obtained through the Service for any purpose other than your own internal business operations.

Share, sell, rent, or otherwise transfer Customer Data extracted from the Service to any third party except as required for your legitimate business operations and in compliance with applicable law.

Store sensitive categories of personal data (e.g., health records, financial account numbers, government identification numbers) in the Service unless you have executed a separate Data Processing Agreement with Solvara Labs and obtained all necessary consents from affected individuals.

2.4 Intellectual Property Violations

Upload, transmit, or distribute any content that infringes any patent, trademark, trade secret, copyright, or other intellectual property right of any person or entity.

Remove, alter, or obscure any copyright, trademark, or other proprietary notices contained in or on the Service.

Use Solvara Labs' name, logo, trademarks, or branding in any manner not expressly authorized in writing by Solvara Labs.

2.5 Harmful, Abusive, or Objectionable Content

Upload, transmit, or store any content that is defamatory, obscene, pornographic, harassing, threatening, or otherwise objectionable.

Use the Service to harass, abuse, stalk, threaten, or harm any individual.

Use the Service to transmit unsolicited commercial communications (spam) or to engage in any deceptive marketing practices.

2.6 Competitive and Reverse Engineering Activities

Use the Service to develop, test, or benchmark a competing product or service.

Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, AI models, or trade secrets of the Service or any component thereof.

Monitor the Service's availability, performance, or functionality for any benchmarking or competitive analysis purpose without Solvara Labs' express written consent.

3. Prohibited Conduct — API and Integration Specific

If you access the Service via our API, you additionally agree not to:

Exceed API rate limits specified in the Documentation or imposed by Solvara Labs from time to time.

Use the API to build applications that access the Service on behalf of users who have not agreed to the Terms of Service and this AUP.

Cache or store API responses containing Customer Data longer than necessary to fulfill the immediate request.

Use the API to aggregate or harvest data from the Service for any purpose not expressly permitted under your subscription plan.

Publicly expose your API credentials or allow unauthorized third parties to use them.

4. Prohibited Conduct — AI Agent (Ask Opsvara) Specific

When using the Ask Opsvara AI Agent, you additionally agree not to:

Attempt to manipulate, "jailbreak," reverse engineer, or extract the underlying model, training data, system prompts, or configuration of the AI Agent.

Use AI Agent outputs as a substitute for professional legal, financial, medical, regulatory, or safety advice without independent verification.

Rely on AI Agent routing, scheduling, or operational recommendations without appropriate human review, particularly where safety, regulatory compliance, or significant financial decisions are involved.

Input into the AI Agent any personally identifiable information beyond what is reasonably necessary for operational purposes, or any data classified as sensitive personal information under applicable law.

Use the AI Agent to generate or distribute misinformation, deceptive content, or content intended to manipulate any person.

5. Customer Responsibilities

5.1 Authorized Users

You are responsible for ensuring all Authorized Users under your account comply with this AUP. You must promptly notify Solvara Labs at [email protected] if you become aware of any actual or suspected violation of this AUP by any Authorized User.

5.2 Account Security

You are responsible for maintaining the confidentiality and security of your account credentials. You must use strong, unique passwords and enable multi-factor authentication where available. You must not share account credentials among multiple individuals — each Authorized User must have their own login credentials.

5.3 Regulatory Compliance

You are solely responsible for ensuring your use of the Service complies with all laws and regulations applicable to your field service operations, including without limitation:

Federal and state pesticide application and chemical handling regulations (e.g., EPA regulations under FIFRA, state department of agriculture requirements).

Environmental protection laws applicable to aquatic treatment, landscape, and outdoor services.

OSHA workplace safety requirements applicable to field worker operations.

Data privacy laws applicable to personal information you collect from your own clients.

Business licensing requirements for your specific service vertical and jurisdiction.

6. Reporting Violations

If you become aware of any violation of this AUP — whether by another user of the Service or by any third party — please report it to us promptly at [email protected]. We take all reports seriously and will investigate and take appropriate action. Solvara Labs reserves the right, but assumes no obligation, to monitor the Service for compliance with this AUP.

7. Consequences of Violations

Solvara Labs reserves the right to take any of the following actions in response to a violation of this AUP, at our sole discretion and without prior notice where urgency requires:

Issue a written warning to your account administrator.

Temporarily suspend your account or the account of specific Authorized Users pending investigation.

Remove or disable access to content that violates this AUP.

Permanently terminate your account and access to the Service.

Report violations to law enforcement or regulatory authorities where required or appropriate.

Pursue legal action, including seeking injunctive relief or damages, for violations that cause harm to Solvara Labs or third parties.

For non-urgent violations, Solvara Labs will generally provide written notice and an opportunity to cure within five (5) business days before taking action, except where the violation poses an immediate risk of harm to the Service, other users, or third parties.

Termination for AUP violations shall be treated as termination for cause under the Terms of Service, and no refunds will be issued for prepaid, unused subscription fees.

8. Modifications to This AUP

Solvara Labs may update this AUP from time to time to address new use cases, security concerns, legal requirements, or platform capabilities. We will provide at least fifteen (15) days' advance written notice of material changes via email to your account's registered address or via a notice posted within the Service. Your continued use of the Service after the effective date of any modification constitutes acceptance of the revised AUP.
